Submitting an enquiry through our website does not create a client relationship or guarantee that we will accept a project.
Any quote or proposal provided by Hawi Labs will be based on the information available at the time. Changes to the project scope, additional features, new requirements, or third-party costs may result in a revised quote.
Unless otherwise stated, quotes are valid for [30 days] from the date issued.
To help a project progress smoothly, clients are responsible for:
Providing accurate project information and requirements
Supplying content, images, logos, and other materials they have the right to use
Providing timely feedback, approvals, and access credentials where necessary
Ensuring that submitted content complies with applicable laws
Reviewing and approving deliverables within the agreed timeframe
Delays in receiving required materials, feedback, or approvals may affect the project timeline.
Payment terms will be communicated in the relevant proposal, quotation, or agreement.
Unless otherwise agreed in writing:
A deposit may be required before work begins.
The remaining balance is due before final delivery, launch, or transfer of the completed project.
Additional work outside the agreed scope may incur additional charges.
Third-party costs, such as hosting, domain registration, premium plugins, themes, apps, or subscription services, may be billed separately.
All payments are subject to the terms agreed upon for the specific project.
The number of revisions included in a project will depend on the agreed scope or package.
Requests that substantially change the original direction, structure, functionality, or requirements may be treated as additional work and quoted separately.
We will make reasonable efforts to accommodate requested changes, but extensive changes may affect delivery timelines and costs.
Project timelines are estimates unless a fixed deadline has been expressly agreed upon in writing.
A project may be considered ready for delivery when the agreed deliverables have been completed and made available for the client’s review or use.
The client is responsible for reviewing the website before launch and notifying Hawi Labs of any issues within the agreed review period.
Some websites may rely on third-party services, platforms, or integrations, including but not limited to:
Hosting providers
Domain registrars
Ecommerce platforms
Payment gateways
Email providers
Plugins, themes, and software services
Scheduling, analytics, or automation tools
These services may have their own terms, fees, privacy policies, availability limitations, and technical requirements. Hawi Labs is not responsible for interruptions, policy changes, price changes, or failures caused by third-party providers.
Unless otherwise agreed in writing:
Upon receipt of full payment, the client will receive the agreed rights to the final website deliverables created specifically for the project.
Hawi Labs retains ownership of its pre-existing tools, processes, reusable code, frameworks, templates, design systems, and other materials developed independently of the project.
Third-party assets, software, plugins, fonts, images, and other licensed materials remain subject to their respective licenses.
Clients are responsible for ensuring they have the necessary rights to content and materials they provide.
Any specific ownership or licensing arrangements will be outlined in the relevant project agreement.
Unless a client requests otherwise in writing, Hawi Labs may display completed work in its portfolio, website, or marketing materials for promotional purposes.
If a project contains confidential information or the client has requested confidentiality, we will respect the agreed confidentiality terms.
Clients are responsible for the accuracy, legality, and ownership of content published on their websites.
Hawi Labs does not guarantee that a client’s website will comply with every industry-specific legal or regulatory requirement unless legal compliance services have been expressly included in the project scope.
Clients should obtain appropriate professional advice for matters such as privacy, accessibility, consumer protection, taxation, or industry-specific regulations.
We aim to provide services with reasonable care and skill. However, we do not guarantee that:
A website will be completely free of errors at all times
A website will remain compatible with every future browser, device, plugin, or third-party service
A website will achieve a particular level of traffic, sales, rankings, leads, or business revenue
Third-party services will remain available or unchanged
To the extent permitted by applicable law, Hawi Labs will not be liable for indirect, incidental, or consequential losses arising from the use of our website or services.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.
We may suspend or terminate a project or service where:
Required payments are overdue
The client requests unlawful work
There is a serious breach of the agreed terms
Continued work becomes impractical due to circumstances beyond our reasonable control
Any consequences of cancellation, including outstanding payments or work already completed, will be handled according to the relevant project agreement.
These Terms & Conditions are governed by the laws of Kenya, unless otherwise agreed in writing or required by applicable law.
Any disputes will first be addressed through good-faith communication. Where a dispute cannot be resolved informally, the parties may pursue the remedies available under applicable law.
We may update these Terms & Conditions from time to time. The updated version will be published on this page with a revised “Last updated” date.
